DUI Attorney in Lynnwood
Direct DUI Defense Informed by Lynnwood Municipal Experience
I defend drivers arrested for DUI and personally handle each case from the initial consultation through its completion. At Johanson Law Group, Inc., I draw on more than 35 years of legal experience, including my service as a former Assistant City Attorney for the City of Lynnwood. That municipal-law background informs how I evaluate the local procedures, evidence, and legal issues that can shape a drunk driving case.
I also served as a Pierce and King County Deputy Prosecutor, giving me insight into how the government evaluates criminal allegations and prepares cases. As your drunk driving lawyer in Lynnwood, I analyze the prosecution’s evidence, identify issues that warrant closer scrutiny, and explain the available defense options.

Where a Lynnwood DUI Case May Be Filed
The law enforcement agency involved and the classification of the charge generally determine which court may hear a DUI case. Arrests made by Lynnwood Police are typically filed in Lynnwood Municipal Court. That court handles misdemeanors and gross misdemeanors, including DUI matters within its jurisdiction. A gross misdemeanor is more serious than a misdemeanor but less serious than a felony.
Arrests involving the Washington State Patrol or the Snohomish County Sheriff’s Office may proceed in Snohomish County District Court South Division. Felony DUI cases are heard in Snohomish County Superior Court in Everett. I determine the applicable court path from the arresting agency, charging documents, and alleged offense, not solely from where the traffic stop occurred.
Washington generally classifies DUI as a gross misdemeanor, but repeat or aggravating circumstances specified by law can elevate the allegation. DUI becomes a Class B felony when a person has three or more qualifying prior DUI offenses within 15 years or a prior conviction for vehicular homicide or vehicular assault while under the influence. A Class B felony is more serious than a gross misdemeanor.
Washington DUI Penalties & License Consequences
A DUI arrest can create two distinct concerns: the criminal case and a separate driver’s license matter. The consequences depend on prior qualifying offenses, test evidence, and the specific allegations. Washington’s penalty schedule includes mandatory minimum jail terms, potential electronic home monitoring alternatives, and fines that increase under certain circumstances.
Potential first-offense consequences listed in my DUI practice information include:
- At least 24 hours and up to one year in jail
- Fines ranging from $865.50 to $5,000
- A 90-day license suspension or a one-year revocation for refusing a test
- Possible alcohol education or treatment
- Mandatory ignition interlock device use for one year
These ranges don’t predict the result in an individual case. The alleged alcohol level, test evidence, prior record, and other circumstances can affect the applicable penalties. I examine both the court charge and the license-related concerns so each receives direct attention.
How I Examine the Evidence in a DUI Case
Field sobriety test results aren’t evaluated in isolation. I examine how the officer explained and demonstrated each exercise and whether the reported observations match the available evidence. Weather, the testing environment, footwear, balance limitations, and other physiological factors may have affected the driver’s performance.
I also assess the circumstances surrounding the stop, arrest, and chemical-test evidence. Breath and blood tests may present different issues depending on how the evidence was obtained and documented. The facts of the arrest determine which challenges may apply.
My DUI-related work includes:
- First offenses
- Multiple DUI allegations
- Felony DUI
- License suspension
- Underage DUI
- Sobriety checkpoints
- Field sobriety tests
- Vehicular manslaughter matters
My published criminal case examples include a DUI dismissal and reduced DUI charges. Those past outcomes aren’t promises about what can happen in another person’s case.
